Meeting of Creditors with William Heitkamp Houston Bankruptcy Court.

The Section 341 meeting of creditors with William Heitkamp Houston Bankruptcy Court is required to be held within 45 days the filing of the chapter 13 bankruptcy in the Houston Bankruptcy Court.  The meetings of creditors are held on the 3rd floor, at 515 Rusk, Houston Texas 77002. Your meeting of creditors with William Heitkamp Houston Bankruptcy Court will take place on Wednesdays or Monday if you are in Galveston.

The courts link may be found at http://www.txs.uscourts.gov/bankruptcy/.  There are certain tasks that need to be done by the attorney in order to have a successful Section 341 Meeting of Creditors. All of these tasks are Critical to having a successful Chapter 13 Bankruptcy with William Heitkamp as the Trustee. We send your Trustee all the documents needed to proceed with preparation of the Section 341 Meeting. These documents are sent 7 to 10 days prior to the meeting so Trustee Heitkamp has time to review them. The Documents are be scanned and emailed to the Trustee.

Documents you will need for the 341 meeting of creditors

The documents needed for the meeting of creditors are listed below. You are required to produce Tax returns for the last 4 years. If the most recent year was recently filed, in most cases you will have to file again if the IRS has not yet processed it.  If they need to be filed again, then we file them with the Bankruptcy Department (Special Procedures) at the IRS Federal Building. In most cases, for special procedures we look at the POC (Proof of Claim) filed by the IRS to determine who is the case worker. We need 3 originally signed copies. At the top of each copy we write the IRS case worker’ s name and your bankruptcy case number. The copy that gets scanned and emailed to the case worker at the William Heitkamp’s office will need to be emailed no later than 7 days prior to the 341 Meeting of Creditors. In some cases the taxes are prepared late or received late and we are not always to send to the trustee within 7 days.

Self Employed Debtors

If the debtor is Self Employed then we need to make sure the Debtor sets an appointment to meet with the William Heitkamp’s CPA at least 10 days prior to the 341 Meeting. If the Debtor does not attend this meeting then the Trustee and/or Judge of Houston Bankruptcy Court will Reset the 341 Meeting of Creditors. If the 341 meeting of creditors gets reset then the Confirmation Hearing will be reset too. Obviously this delays the entire process more than it needs to.

Child Support

If there is Child support obligations then we need to forward the DSO (Domestic Support Obligation) information to the Trustee. WE provide who receives the money and their address.
